This new regulation is expected to result in around 3,800 fatalities being prevented over the next century.

Since May 2004 it has been a LEGAL requirement for all building owners and / or managers of non domestic properties including common areas of managed residential buildings to undertake an inspection which must meet the criteria of the ‘duty to manage’ (regulation 4) of the Control of asbestos at work regulations 2002. failure to comply with this regulation and the subsequent exposure to asbestos by a member of staff or public could result in a £20,000 fine for each instance and / or a 2 year prison term.

The health and safety executive and environmental health departments will enforce this policy and it is therefore essential that the inspections are made and the information produced is made readily available to all interested parties who may wish to visit your building to undertake work or access controlled or confined areas.

All our surveyors are qualified to a minimum P402 with a majority attaining the higher level S301 accreditation and the company also holds full insurance including professional indemnity.

Who is responsible?
Building owners and building managers, including managed residential properties, must commission an asbestos survey to be carried out or presume all materials contain asbestos unless proven otherwise. If you are a tenant and have a full repairing and insuring lease you are responsible for the assessment and management of any asbestos within your building.

Also have an asbestos register with risk assessments and recommendations available on site at all times. Any persons carrying out work within the building must first consult the asbestos register and take the necessary course of action to prevent exposure to asbestos dust and spread of asbestos contamination.
