Regulation 4 - a duty to manage

The new regulation 4 requires the identification and management of all asbestos within the workplace.

This 'duty to manage' will come into force in spring 2004 where by then all work premises containing asbestos should have an asbestos register. Under this new regulation, the duty will require:

reasonable steps to be taken to determine the location and condition of materials likely to contain asbestos (Carry out a type 2 or 3 asbestos survey)
a presumption that materials contain asbestos unless there is strong evidence that they do not; (Carry out a type 1 survey)
a written record to be made of the location and condition of the asbestos or presumed asbestos in your premises (Produce a survey report, register or database);
a risk assessment to be made; (part of the survey report)
a plan to be prepared which sets out how the risk is to be managed;
implementation of the plan;
passing on information about asbestos-containing materials (ACM's) to those who need it;
monitoring and reviewing arrangements to be in place keeping a check on the condition of the asbestos and presumed asbestos-containing materials.
